Federal Appeals Court Freezes OSHA’s Employee Vaccine Mandate Emergency Temporary Standard
On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit issued an opinion to stay OSHA’s Emergency Temporary Standard on workplace Covid-19 vaccination and testing. The Court’s opinion deemed the regulation illegal and unconstitutional. Additionally, the court determined that it was conceived in bad faith and focused on its economic costs while underplaying its potential benefits and the pandemic’s toll.
